Mais pourquoi, en France, tout débat se déroule-t-il toujours au niveau des principes et jamais à celui de l'utilité pratique? Emphase…..

et c'est vrai que lorsque on a comme souci uniquement l'utilitarisme tout est beaucoup plus facile.Ainsi Richard Posner, juge suprème nommé par Bush
qui plaidoyait pour la création d’un marché de vente et d’achat de bébés, sur la base qu’un tel marché mènerait à un résultat plus efficient que le système d’agences gouvernementales.

Voici le fils de Posner (éric) qui
propose de limiter le premier amendement, pas touche à mon amendement,
pour combien de temps encore ?

Rappelons que dans la constitution US, le premier amendement est la liberté de parole et le deuxième le droit d'avoir une arme

1) Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.

2) A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.

Ne doutons pas que nos amis US trouverons une solution pragmatique, le pragmatisme est de rigueur au pays de Jefferson, ainsi l' amendement numéro 13, qui interdit l'esclavage sauf en cas de condamnation pour crime, ce qui est bien pratique pour faire travailler les prisonniers dans les prisons US

Neither slavery nor involuntary servitude, except as a punishment for crime whereof the party shall have been duly convicted

Notably, the Amendment does allow a person convicted of a crime to be forced to work. Thus, prison labor practices, from chain gangs to prison laundries, do not run afoul of the Thirteenth Amendment.

The Thirteenth Amendment has also been interpreted to permit the government to require certain forms of public service, presumably extending to military service and jury duty.

ideological positions rather than reach a reasonable compromise, one that would most likely include incremental restrictions on gun rights and enhanced surveillance of suspected extremists.

b) Exemple 2 : cas des russophones baltes

It seems to me that in the future the biggest problems will be Estonia and Latvia. Both are little countries with big Russian
populations. Both are also NATO members, so the West is committed to defending them. Everything should be done to ensure the Russian minorities in those countries will be unresponsive when Putin starts stirring up trouble.
